Understanding the Application to End a Tenancy and Evict a Tenant (Form L3) in Ontario

If you are a landlord in Ontario and your tenant has given notice to end their tenancy or you and the tenant have mutually agreed to terminate the rental agreement, you may need to formally apply to end the tenancy through the Landlord and Tenant Board (LTB). The official form used for this process is known as Form L3. This article provides a comprehensive overview of the purpose, eligibility, and step-by-step procedures for completing and submitting this form.

Purpose and Scope of Form L3

Form L3 is specifically designed for landlords who wish to obtain an order from the LTB to end a tenancy and evict a tenant when the tenant has either:

  • Provided a notice to end the tenancy, or
  • Agreed to end the tenancy with the landlord.

This form facilitates the formal legal process to ensure the tenancy is terminated in accordance with Ontario’s Residential Tenancies Act, 2006.

Eligibility Criteria for Using Form L3

To use this form, the following conditions must be met:

  • The tenant has issued a notice to end the tenancy, or both parties have mutually agreed to terminate the lease.
  • The notice or agreement specifies a clear end date for the tenancy.
  • The application is filed within 30 days of the tenancy’s scheduled end date as indicated in the tenant’s notice or the agreement.

It is important to note that this form is not applicable if the landlord seeks to terminate a tenancy for reasons such as non-payment of rent or other grounds not related to mutual agreement or notice to end.

Step-by-Step Procedure for Completing the Form

Part 1: General Information

Begin by providing details about the rental unit, including:

  • The full address, including street number, name, type, and postal code.
  • Your contact information as the landlord, including name, address, phone numbers, and email.

Next, list the tenant(s) involved, including their names and current mailing addresses if different from the rental unit. If there are other unresolved applications related to this rental unit, include their file numbers.

Part 2: Reason for Application

Indicate whether the tenant issued a notice to end the tenancy or if both parties agreed to end it. Also, specify the exact date when the tenancy is scheduled to end, using the format day/month/year.

Part 3: Signatures

The application must be signed by either the landlord or their legal representative. If a representative signs, their contact details and LSUC (Law Society of Ontario) number should be included. The signing date must also be provided.

Filing the Application

Once completed, all pages of the form must be filed with the LTB within 30 days of the tenancy’s scheduled end date. The application fee is $201, payable by certified cheque, money order, or credit card. If submitting by mail or courier, cash and debit payments are not accepted. Online payment is also available, with the receipt and application emailed to [email protected].

  • A signed declaration or sworn affidavit confirming the contents of the notice or agreement.

Important Considerations and Next Steps

After filing, the LTB generally issues an order to end the tenancy without a hearing, provided all documentation is in order. If there are discrepancies or disputes, a hearing may be scheduled. It is an offense under the Residential Tenancies Act, 2006 to submit false or misleading information, so accuracy is essential.
